Generally, no. When you accept a settlement, you sign a release that permanently waives your right to pursue additional compensation for that injury from that defendant. Settlements are final. You cannot come back later if your injuries turn out to be worse than expected or if you discover additional damages. This finality is especially dangerous with severe injuries. Catastrophic injuries often have complications that emerge over time, care needs that increase, and lifetime costs that are difficult to predict. Settling too early without comprehensive life care planning and expert analysis can leave you without resources when you need them most. This is why it's critical not to settle too early or without fully understanding the long-term impact of your injuries. At Kane Trial Law, we strongly advise clients not to accept settlements until they've reached maximum medical improvement (MMI) and we can accurately calculate the full value of their claim.
