Colorado significantly increased its damage caps effective January 1, 2025:
General personal injury (non-economic damages): $1.5 million (previously ~$642,180) Wrongful death: $2.125 million (previously ~$571,870) Medical malpractice non-economic: Phasing in from $555,000 (2025) to $1.575 million (2029)
The caps apply based on when your lawsuit is filed, not when the injury occurred. Beginning January 1, 2028, caps will adjust for inflation every two years. Economic damages (medical bills, lost wages) are not capped. These increased caps represent a major victory for injured Coloradans. For catastrophic injury victims, this change is especially meaningful. The previous caps meant that someone with life-altering injuries could receive the same non-economic damages as someone with far less severe injuries.
