Can I Sue Snapchat in Colorado? Claims Against Social Media Companies

While social media platforms such as Snapchat, Facebook, Instagram and Tik Tok have become widely used by all age groups, potential dangers exist for teens and young adults throughout Colorado. What legal remedies are available to parents and adults due to harms caused by social media? 

What are some negative effects of social media? A study found that teens (and adults) can become addicted to social media sites. Particularly in teens and young adults, the dopamine effect of engaging on social media can caused their still-developing brains to become addicted, much like narcotics or other habit-forming substances. Further, the Surgeon General recently issued an Advisory on the negative impact of social media on youth mental health. Another study indicates that upwards of 35% of teens are using social media "almost constantly."

Other dangers associated with social media, particularly Snapchat, is the hidden nature of the communications. Snapchat allows individuals who "snap" to have the messages or photos disappear after a certain time period. It also allows potentially dangerous criminals like drug dealers to pose as teens and connect with people in their vicinity. Colorado's Attorney General recently released a report on social media, fentanyl and illegal drug sales and joined a lawsuit with others states against Snapchat's parent company.

Depression, anxiety, sexual abuse and eating disorders are also potential effects of too much social media use in teens. 

What claims are available to victims of social media? While a relatively new area of law, parents of deceased teens and young adults have brought wrongful death and negligence claims against Snapchat, Tik Tok and Meta (Facebook's parent company). As mentioned above, many states, including Colorado, have also brought claims against the corporations to further regulate social media and help curb the health risks associated with their use.
