Should I Talk to the Insurance Adjuster After an Injury Accident in Colorado?

Posted by Michael P. Kane | Jun 23, 2025 | 0 Comments

If you've been injured in a car accident in Castle Rock or anywhere in Colorado, chances are you'll be contacted by an insurance adjuster within days, or even hours, of the crash. While it might seem harmless to talk to them, doing so can seriously impact the outcome of your injury claim.

At Kane Trial Law, we always recommend consulting with an experienced personal injury attorney before speaking to any bodily injury adjuster. Here's why, and what you should do instead.

Why You Should Avoid Talking to the Bodily Injury Adjuster Alone

Insurance adjusters work for the insurance company, not for you. Their job is to gather information that minimizes the value of your claim or justifies a quick, lowball settlement. Speaking to them too soon after an accident can hurt your case in several ways:

1. You May Not Know the Full Extent of Your Injuries

It can take days or even weeks for injuries like concussions, whiplash, or soft tissue damage to fully present. If you give a statement saying you're “okay” or “feeling fine” shortly after the crash, the insurance company will use that against you later.

2. Recorded Statements Can Be Twisted

Never give a recorded statement to an adjuster without first consulting a lawyer. Even innocent phrases can be used out of context to discredit your experience or downplay your injuries.

3. Medical Record Releases Are a Trap

Do not sign a medical release allowing the insurance company to access your full medical history. They will often try to use unrelated prior injuries or conditions as a reason to reduce or deny your claim.

When It's OK to Talk to the Insurance Company

There's one situation where limited communication is acceptable: property damage claims.

If your vehicle was damaged in the accident, it's usually fine to speak with the property damage adjuster to schedule a vehicle inspection or receive compensation for repairs or a total loss. Just be sure to limit your conversation strictly to the damage to your vehicle, and avoid discussing your injuries.
