Why I Wrote After the Impact: A Trial Lawyer's Guide to Serious Injury Claims, Insurance Power and Justice

By Michael P. Kane | Founder, Kane Trial Law | Castle Rock, Colorado

I'm pleased and proud to announce the publication of my new book, After the Impact: A Trial Lawyer's Guide to Serious Injury Claims, Insurance Power and Justice.

After more than twenty years doing this work, I wanted to write a book about what really happens when someone suffers severe harm through no fault of their own. I also wanted to highlight what most people don't understand about the personal injury claims process until they're forced to experience it themselves.

But this isn't just a book about personal injury law. I incorporated stories drawn from people whose lives have been turned upside down by someone else's negligence or reckless conduct. I also discuss the enormous imbalance of power between insurance companies and the individuals seeking compensation for their injuries. It's also about the important role that dedicated trial lawyers play in helping ordinary people obtain justice.

Finally, I wrote After the Impact because I believe people deserve to understand the system they're entering, particularly when their health, financial security, and futures are at stake.

After the Impact: A Trial Lawyer's Guide to Serious Injury Claims, Insurance Power and Justice by Michael P. Kane

What Readers Will Find in After the Impact

The book combines real-world litigation experiences from my time as a prosecutor and in civil practice, courtroom stories, and practical information about navigating serious personal injury claims.

Among other subjects, I discuss:

  • How personal injury claims work and why severe injury cases can be particularly complicated.
  • The role of insurance companies and the financial interests that influence claims decisions.
  • How experienced trial lawyers handle these claims and the mindset we take when advising our clients.
  • Why preparing every case as if it were headed to trial is critical to obtaining the best possible result for an injured person.
  • The importance of accountability and the role of plaintiff attorneys play in protecting injured people.
  • Why the public at large has a negative connotation about trial lawyers and what the good one's do to overcome that.

My goal was the make these subjects understandable to readers who may have little or no experience with the legal system.

I'm proud to be a plaintiffs' trial lawyer. I'm proud of the clients I've represented, the cases I've tried, and the role our profession plays in making the civil justice system accessible to ordinary people.

Part of my motivation for writing After the Impact was to share that perspective.

I hope readers come away with a better understanding not only of how serious injury claims work, but also of why dedicated, principled trial lawyers matter. And why the work we do deserves to be judged by more than the advertisements people see along the highway or the commercials on tv.

If this book helps injured people make better-informed decisions and gives readers a greater appreciation for the important role that plaintiff lawyers play in our civil justice system then it will have accomplished exactly what I hoped.
