Winter Driving Regulations: Colorado's Chain and Traction Laws Explained

Posted by Michael P. Kane | Nov 19, 2024 | 0 Comments

Winter is upon us here in Colorado and with that comes an increase in adverse driving conditions throughout the state. In 2023, Colorado had over 100,000 crashes with over 42,000 occurring between November and March. While speeding is listed as the top cause of car accidents in Colorado, speeding in snowy or icy conditions is particularly dangerous.

In an attempt to reduce motor vehicle crashes during winter months, the Colorado Department of Transportation (CDOT) implements chain and traction laws for both commercial and passenger vehicles.

Colorado's Chain Law Explained. According to CDOT, between September 1 through May 31, all commercial vehicles traveling I-70 between Mile Point 133 (Dotsero exit) and Mile Point 259 (Morrison exit) must carry chains sufficient to be in compliance with the Colorado chain law.

Commercial vehicles are those with a gross combination weight rating in excess of 16,001 pounds or vehicles designed to transport 16 or more passengers, including the driver.

Colorado's Traction Law Explained. All motorists are required to have either an all-wheel drive or four-wheel drive vehicle, or (for two-wheel drive vehicles) snow tires or all-weather tires with a mud/snow designation. The tires must have a minimum 3/16th inch tread depth. Any vehicles that don't meet the previous categories must carry and utilize alternate traction devices (i.e. chains) when the traction law is in effect.

If a driver disregards the Chain Law or Traction Law and crashes into someone, they are subject to additional fines. Importantly, a willful decision to violate the traction law could also be a basis for a punitive damages claim in a civil personal injury lawsuit as well.

Please be safe on the roadways this winter. If you or a loved one is hurt by a dangerous driver on snowy roads, please contact Kane Trial Law at 303-919-7777 for a free consultation.
